Finotta, Inc. (“Finotta”) respects your privacy and understands the importance of privacy to our users. Finotta developed this Privacy Policy (the “Policy”) to explain how Finotta collects, uses, shares, and protects Personal Information (defined below).This Policy applies to Personal Information collected on our website, and any other website from which this Policy is linked (collectively, the “Site”).

What is Personal Information?​

“Personal Information” is information that, either alone or in combination with other information, identifies or relates to a particular individual. Examples of Personal Information include, among others, name, email address, phone number, mailing address, banking information, test information, and online identifiers.

 

Types of Personal Information Finotta Collects and Uses 

 

Personal Information that you provide Finotta

To provide you the Site, in various places within the Site, Finotta may request you provide Finotta certain Personal Information. Finotta does not collect any Personal Information revealing racial or ethnic origin, political opinions, religious or philosophical beliefs.  

For example, when you choose to create an account, Finotta may request you provide certain Personal Information, including, but not limited to:

  • Name;

  • Username; 

  • Cell phone number;

  • Email address;

  • Date of birth;

  • Geolocation; and 

  • Login information associated with your Gmail account or social media accounts that you use to connect to the Site (this could include, for example, your Facebook or Instagram account). 

 

Finotta will indicate on the form whether a particular field of Personal Information is mandatory or optional. If you choose not to provide certain Personal Information, Finotta may not be able to provide the requested Site. 

Personal Information Finotta Automatically Collects from You

Finotta collects the following types of Personal Information automatically through your use of the Site:

  • Cookies, Device Identifiers, and Similar technologies

Cookies are small data files that are transferred to your computer’s hard disk and are used to store information about website visits, your preferences, and enhances website functionality. To improve your overall experience with the Site, we may use cookies, device identifiers, and similar technologies such as pixels, web beacons, and local storage for the following purposes: to improve the functionality of the Site, to remember your online preferences within the Site, and to help us better understand how you interact with the Site.

To assist us with analyzing the traffic to the Site through cookies or similar technologies, Finotta may use analytics Site, including Google Analytics.  For more information on Google Analytics’ processing of your information, please see “How Google uses data when you use our partners' sites or apps.”  

  • Advertising

Finotta may engage third parties, including social media platforms, who may use cookies, pixel tags, and other storage technologies to collect or receive information from the Site or elsewhere on the internet to provide marketing Site to Finotta, including targeted advertising.   • Geolocation Information

To improve the accuracy of the Site, Finotta may track your location-based information from your mobile device, either continuously or while you are using the Site. If you wish to change Finotta’s access or permissions, you may be able to do so in your mobile device’s settings menu.

  • Log File Information

When you use the Site, Finotta’s servers automatically record information, including your Internet Protocol address (“IP Address”), browser type, referring URLs (e.g., the site you visited before coming to the Site), domain names associated with your internet service provider, information on your interaction with the Site, and other such information (collectively, “Log File Information”). Finotta may also collect similar information from emails sent to you which then help Finotta track which emails are opened and which links are clicked by recipients. 
 

How Finotta Uses Personal Information

Finotta uses or in the future may potentially use Personal Information for the following purposes:

  • Offering the Site to you; 

  • Administering and improving the Site; 

  • Enabling secure use of the Site; 

  • Sending you information and promotional materials;

  • Protecting Finotta’s rights and intellectual property;

  • Meeting legal obligations; and

  • For other purposes related to the reasons for which you provide Personal Information.

 

Finotta will retain your Personal Information only as long as necessary to fulfill the purposes for which Finotta collected and processed the Personal Information, or as required by applicable laws.  

Disclosure of Personal Information

Finotta will not disclose Personal Information except as set forth in this Policy. This Section describes to whom Finotta discloses Personal Information and for what purposes:

  • Service Providers. Finotta engages service providers to perform tasks on its behalf and to assist in operating the Site. For example, Finotta may use third-party service providers to provide the necessary hardware, software, networking, storage, and related technology required to operate the Site. Finotta takes commercially reasonable steps to help ensure its service providers provide at least the same level of protection for Personal Information as Finotta does.

  • Companies Involved in Mergers and Acquisitions Transactions.  If Finotta sells or otherwise transfers part or the whole of its business or assets to another organization (e.g., in the course of a transaction like a merger, acquisition, bankruptcy, dissolution, or liquidation), any Personal Information collected through the Site may be among the items sold or transferred. 

  • Law Enforcement, Government Agencies, and Courts.  Finotta may disclose Personal Information at the request of law enforcement or government agencies; in response to subpoenas, court orders, or other legal process; to establish, protect, or exercise Finotta’s rights; to defend against a legal claim; to protect the rights, property, or safety of any other person; or as otherwise required by law.

How Finotta Protects Personal Information 

In accordance with industry standards, Finotta uses administrative, technical, and physical security measures to help protect your Personal Information under Finotta’s control. However, while Finotta attempts to ensure the integrity and security of Personal Information, Finotta cannot guarantee that its security measures will prevent third parties such as hackers from illegally obtaining access to Personal Information. Finotta does not represent or warrant that Personal Information about you will be protected against, loss, misuse, or alteration by third parties. 

Retention and Deletion

As discussed above, Finotta keeps your Personal Information only as long as necessary to fulfill the purposes for which it was collected and processed, including for the purposes of satisfying any legal, regulatory, accounting or reporting requirements. In some circumstances, Finotta may de-identify, aggregate, or otherwise anonymize your Personal Information consistent with applicable laws and industry standards so that it can no longer be associated with you, in which case it is no longer treated as Personal Information.

 

Accessing, Updating, or Deleting Personal Information 

If you would like to otherwise access, update, or delete Personal Information about you, you may submit a request to Finotta by using the contact information in Section 13 (How to Contact Finotta) below.  

 

Opting Out of Receiving Electronic Communications 

To provide you information regarding the Site, Finotta may send you newsletters, marketing materials, surveys, or other information via email, text, or other electronic method (“Communications”). You may choose to stop receiving Communications by clicking on the conspicuous “Unsubscribe” link located at the bottom of any Communication Finotta sends to you. Please note that certain Communications are necessary for the proper functioning and use of the Site and you may not have the ability to opt out of those Communications.  

 

International Use of the Site

If you use the Site outside the United States, please be aware that Personal Information may be collected, stored, and processed in the United States. Finotta will not transfer Personal Information internationally. Please be aware that the data protection laws of the United States might not be as comprehensive as those in your country.  

 

Must be Sixteen (16) years old to Use the Site

The Site is intended to be used solely by individuals sixteen (16) years of age or older. Finotta does not knowingly collect or solicit Personal Information from minors under the age of sixteen (16). In the event that Finotta learns that Finotta has collected Personal Information from a minor under the age of sixteen (16), Finotta will promptly take steps to delete that information. 

 

Third Party Links

Finotta is not responsible for the practices employed by any websites or Services linked to or from the Site, including the information or content contained within them. A link to a third party’s website should not be construed as an endorsement. Finotta encourages you to investigate and ask questions before disclosing Personal Information to third parties.  

 

Changes to the Policy 

Finotta may modify or update this Policy from time to time, so please review it periodically. If Finotta makes a change to this Policy that, in its sole discretion, is material, Finotta will notify you as appropriate under the circumstances. Unless otherwise indicated, any changes to this Policy will apply immediately upon posting to the Site.
